1. Definitions
1.1. “We”, “us” and “our” refer to The Tax Refund Company, the trading name of PTS (Stockport) Ltd, a company incorporated in England and Wales (Company number: (09393187) and registered at 89-91 Buxton Road, Stockport, SK2 6LR
1.2. “You” and “your” refer to you or anyone else using our Service.
2. The Guarantee
2.1. We guarantee that by completing our review, if you are entitled to an income tax refund we will secure the largest possible income tax refund from HMRC on your behalf.
2.2. If we recover an income tax refund for you and you discover that HMRC should have repaid more than the amount we recovered, we will pay you the difference between the amount we should have recovered for you and the amount we actually recovered for you, without any deduction for fees, subject to the following:
2.2.1. You answered all the questions and provided all the information we requested at the time we conducted your review
2.2.2. The information and answers you provided were true and accurate
2.2.3. The refund we failed to claim must relate to the same tax years we reviewed for you
2.2.4. You must have signed Form 64-8 and Deed of Assignment and given us the opportunity to recover the missing amount from HMRC
2.2.5. HMRC must not have paid the monies to you already
2.2.6. You must have contacted us in writing stating that you wished to make a claim under this guarantee within 6 months of the date on the refund cheque we issued to you
3. The maximum amount we will pay in the event of a claim under The Guarantee is £1,000 (one thousand pounds sterling).

1. Definitions

1.2. “You” and “your” refer to you or anyone else using our Service.
2. The Guarantee
2.1. We guarantee that if you complete our tax code review and we subsequently submit a claim to HMRC requesting repayment of income tax and as a result of our claim you receive a demand for underpaid tax, we will pay the amount HMRC are demanding, subject to the following:
2.2.1. You answered all our questions and provided all the information we requested at the time we conducted your review and you informed us of any underpayment demands already issued by HMRC prior to our submission of your claim
2.2.2. The information and answers you provided were true and accurate
2.2.3. The demand for underpaid tax relates to the same tax years we reviewed for you
2.2.4. HMRC confirms in writing that the underpayment has been identified as a result of the claim we submitted on your behalf
2.2.5. The demand is not resulting from an adjustment we have made to your and your spouse’s / civil partner’s tax codes whereby the amount of the demand is offset by your spouse / civil partner receiving a reduction in their tax liability for the same period
2.2.6. If requested you have signed a second HMRC Form 64-8 giving us authority to deal directly with HMRC on your behalf
2.2.7. You have answered any additional questions and provided all the additional information we have requested following the receipt of the Underpayment Demand from HMRC
2.2.8. You must have contacted us in writing stating that you wished to make a claim under this guarantee within 21 days of the date on the Underpayment Demand HMRC has issued to you.
3. The maximum amount we will pay in the event of a claim under The Guarantee is £1,000 (one thousand pounds sterling).
